I was charged with Criminal Mischief of the Fourth Degree, Making Graffiti and Possession of Graffiti Instruments. On or about 4:20 pm the defendant intentionally damaged property of another while having no right to do so nor any reasonable grounds to believe that he had such a right; the defendant made graffiti on the property of the owner; the defendant possessed an instrument and substance commonly used to place a mark upon a piece of property under circumstances evincing an intent to do the same to damage property;

The factual basis for these charges are as follows: I observed the defendant standing in front of a billboard holding a marker at the above location. I further observed the defendant write on the billboard. I further observed the defendant walk away from the billboard. I approached the billboard and saw the tag " CLOWN SOLDIER" written in white paint on the billboard. I recovered one black permanent marker, one white paint marker and two slap stickers from inside the defendant's front right pocket. I examined the recovered instruments and based on my training and experience as a police officer in the identification of graffiti instruments, I know that markers and stickers are types commonly used to make graffiti on property.
